Terms of sale

1. Seller

2. Offer and prices

CapTrail offers a single subscription giving access to all the features of the app and of the web app (route planning, Comfort and Engaged styles, zones on the map, guided navigation, GPX import and export), described in the features section of the home page.

Two durations to choose from:

• monthly: €4.99 per month, all taxes included;
• annual: €29.99 per year, all taxes included.

Prices are shown in euros, all taxes included. The applicable price is the one shown by the store when the purchase is confirmed; it may vary depending on the country and the store.

If the price changes, you are informed in advance. The new price only applies from the following period and, where the store requires it, only with your agreement; you can cancel before it applies.

3. Free trial

On the first subscription, a 7-day free trial is offered, depending on the configuration of the store used. No amount is charged during the trial.

Unless cancelled at least 24 hours before the end of the trial, the chosen subscription starts automatically when the trial ends and the first payment is taken.

The trial is offered only once per store account. Any unused part of the trial is lost if you take out a paid subscription during it.

4. Subscription and payment

You can subscribe:

• in the app for iPhone and iPad, through the App Store: payment is processed by Apple and charged to your Apple account;
• in the Android app, through Google Play: payment is processed by Google and charged to your Google Play account;
• in the web app: card payment is processed by our payment provider, through the RevenueCat subscription platform.

Before confirming, you see the plan, its price, the length of any trial and the renewal conditions. Confirming constitutes acceptance of these terms of sale. Payment is charged when the purchase is confirmed or, if there is a trial, when the trial ends. A confirmation is sent to you by the store or by email.

An active subscription gives access to the service in the app and in the web app, with the same account.

5. Term and renewal

The subscription is taken out for one month or for one year. It renews automatically for the same period, at the price then in force, unless cancelled at least 24 hours before the end of the current period. The renewal is charged within the 24 hours before the renewal date.

For the annual subscription, we remind you in writing, no earlier than three months and no later than one month before the renewal date, that you may choose not to renew it (article L215-1 of the French Consumer Code).

6. Cancellation

You can cancel at any time, free of charge:

• in the app: Account tab › Subscription › “Manage my subscription”;
• for an App Store subscription: in your Apple account settings, under Subscriptions;
• for a Google Play subscription: in Google Play, under Payments and subscriptions;
• for a subscription taken out on the web: from “Manage my subscription” in the web app, or by writing to us at contact@captrailapp.com.

Cancellation takes effect at the end of the current period: access remains active until then, and the period already started is not refunded pro rata, except in the cases provided for by law or by the store’s terms.

Deleting your CapTrail account does not cancel the subscription.

7. Right of withdrawal

You have 14 days from the subscription to withdraw, without having to give any reason (article L221-18 of the French Consumer Code).

By subscribing, you ask for the service to start immediately. If you withdraw after the end of the free trial, you remain liable for an amount proportionate to the service provided until you communicated your withdrawal (article L221-25). During the free trial, nothing is owed.

To exercise this right:

• purchase on the App Store: request a refund from Apple at reportaproblem.apple.com;
• purchase on Google Play: request a refund from Google from your Google Play account (Google Play Help);
• purchase on the web: send us an unequivocal statement, for example using the form below, at contact@captrailapp.com.

For App Store and Google Play purchases, Apple and Google handle payment and refunds under their own terms; you can also write to us, and we will help you through the process. For web purchases, we refund you within 14 days of your withdrawal, using the payment method you used.

8. Guarantees

You benefit from the guarantee of conformity of digital content and services provided for by the French Consumer Code (articles L224-25-1 et seq.) for the whole term of the subscription. In the event of a lack of conformity, you can have the service brought into conformity or, failing that, obtain a price reduction or the termination of the contract.

9. Complaints

For any complaint, write to contact@captrailapp.com.

These terms of sale are governed by French law, without depriving you of the protection of the mandatory provisions of the law of your country of residence in the European Union.

10. Withdrawal form

Complete and return this form only if you wish to withdraw from a subscription taken out on the web.
